Of the 4 justices who voted against it, 3 of them should not be on the court at all. Gorsuch, upon his nomination by Trump, should have said he cannot in good conscience accept it based on McConnell not holding hearings on Merrick Garland, Obama's nominee. Kavanaugh should have been rejected based on his past behavior, as should have Clarence Thomas.
