Fair question. It is different this time because of the 6-3 conservative majority on the Supreme Court. The last time the court was this conservative was the 1930s. In the past, there have been largely 5-4 majorities with 1 or 2 swing voters, which meant the court could keep conservatives in check. Not anymore. They have no fear of a swing voter upending their desires.
